ICBA urged the Federal Reserve Board to establish a new, agency reserve account that would permit bankers' banks and other correspondent banks to deposit overnight, aggregated respondent excess funds with Reserve Banks and pass back the proportional interest to their respondents. The plan would help stem bankers' banks record outflows, which is partly the result of a recently approved Fed policy to pay interest on required reserve and excess balances at Federal Reserve Banks.

This week, the Office of the Comptroller of the Currency said it will not issue guidance allowing banks to provide workout programs to credit card borrowers that allow them to repay less than the full amount owed over time — while deferring loss recognition and income reporting. The Financial Services Roundtable and Consumer Federation of America jointly had requested such guidance in a letter to OCC last month.

ICBA told the SEC in a comment letter that mark-to-market accounting inappropriate for community bank financial statements and current standards have exacerbated the current financial crisis. Accounting measures should reflect more closely the way financial instruments generate earnings and cash flows, ICBA stated, regardless of whether active markets for the instruments typically exist.

Late yesterday, the Treasury Department and Federal Reserve issued a joint final rule that implements the Unlawful Internet Enforcement Gambling Act of 2006. The act prohibits gambling businesses from knowingly accepting payments in connection with unlawful Internet gambling, including payments made through credit cards, electronic funds transfers, and checks. The final rule requires US financial firms that participate in designated payment systems to establish policies and procedures that are "reasonably designed" to prevent payments to gambling businesses in connection with unlawful Internet gambling.
